On November 4, 2021, the Biden Administration released two federal rules regarding employee vaccine mandates. The OSHA Emergency Temporary Standard (ETS) was subsequently put on hold by a federal judge in response to litigation against the Biden Administration. The CMS Rule remains in effect and applies to all FQHCs. It has primacy over the OSHA ETS and FQHCs must demonstrate compliance in two phases: December 5, 2021 and January 4, 2022.
